Usually we
- 1:57Um like to talk but for the sake of leaving the phone calls or the types of phone And they would some but not certainly not lease terminations. reasonable accommodations, evictions, warrant of evictions, order And um and that would involve what's going on have opted into that was set back in April of '74. April of 2024. okay. to cure any kind of violation in the to privacy right to quick quiet enjoyment, to quiet Self help, which I can explain when the Warranty of habitability and repairs, The roommate law
- 3:45roommate law. Actually uh real property law, but we can get into are the kind of things that I deal with County, and I like to do the best I can landlords, you know, they should be well. so I was hoping that we might have some But, finished their speaking to answer any questions on these things, terminations, terminations of tenancy, reasonable modifications, show cause, rent increases, some good 10-days notice to cure, the right of a quiet enjoyment, and the warranty of habitability, roommates. that covers pretty much a lot of the
- 5:18I'll be happy to go into detail on any in when we call for the questions and So, I guess we can just give you all a That's informal. Okay. chief code enforcement officer for the Um safety. Um I wanted to stress that all and healthy living conditions. reasons that tenants might need to is refusing to repair or is unable to uh heat should be coming on on October 1st and he should be provided he should should a minimum 68° of heat. 110°. you have any issues with your smoke
- 6:47any pest infestations roof leaks, um these are the reasons Um but again, that's after you make be your first point of contact. We when you can't Um we're also neutral in a sense where tenants aren't providing sanitary or they're over cluttering the house, of the neighbors or anything like that event of an emergency your home, they should be able to do so also or anybody that's Um and also if they're causing Um like batteries or anything like that. we'll see what we can do to take other means if we have to.
- 8:21So just a quick little bit of background over this, but we're going to go down minutes or so 10-15 minutes to talk and answer section at the very end for on Zoom or in the audience tonight. I'm a managing attorney at the Um based in Albany, but we do cover grants. unit and our um with our housing grants. got all these nice notes I'm all jealous and stuff. what the one thing that I want to make lawyer who is has been take slots for
- 9:19getting evicted and we don't hardly ever tell our support staff, "Okay, you can Albany if you don't have any Columbia look at it every day and she doesn't get Green. So I would just say know anybody who's getting evicted who they should call us. I've got our 833-628-0087. The way that our intake system works is eligible for one of our grants and we're lawyers, so we have to you know, they will get assigned to an attorney or in housing. And if you're you know, you've you've got a landlord who is evicting
- 10:23um, you can call have now, which were we're applying for different name, but it's 80% of AMI, the we used to have go under step, which like a family of four could make up to not that many people. Now, I think a under this grant can make up to I think really for for low and moderate income um, and households that, you know, can still get our help. So, I wanted to We are only we only since we have such um, to cover five counties. Uh, and and
- 11:19counties are extremely busy. So, we have somebody calls up and and not in court yet, they've just gotten an two lawyers and a paralegal that all advice calls. They They We open the They like they have a call every hour. through the day. They open the case. advice and then they close the case. day. Once in a while, they'll, you know, something like that. But, mostly it's they say, "If you get served court um you know, the the lawyer that I have for months ago. So, I won't let her go to
- 12:11I'm her supervisor. And I haven't been aren't getting the calls. So, people advice only, um that can be really just any criminal cases. Yeah. issue that's within what we do like a or um other kind of issues that are paralegal, that's, you know, I don't I think seven or eight. So, that's of people that are that are giving we have to limit our intake to for who are in court for later because we just have an eviction notice before precious slots that we have for our
- 13:11were in court or had the you know, the and we don't have any slots for them. with our limited intake slots. We're who need our help the most. And so, we Um up another lawyer or two. So, then um handle more cases. we also have we we have a lot of units that we have in different areas low-income taxpayer clinic. So, people with that. We have a disability unit um people um appeal like SSI and SSD terminations, too. I have to be careful because we have
- 14:08others. And I'm I know the housing stuff cuz I know we have like senior legal don't think we have it down here. I uh in other like in other counties. I but basically if you or somebody you can't afford to hire a lawyer on their Um Uh and is we defend evictions. That's 90% of their uh Section 8 voucher terminated, at and possibly handle. Um, cuz we do paralegals that that that can do that denied assistance like DSS, that's pretty much any um kind of issue. And
- 15:05and then with an eviction they can't should call us because we have a lawyer there and we're working Uh um going to talk a little bit about the and I probably posted that now with my keep going because the judge and the over that stuff. So. Well, I mean I mean, in in 2019, it seemed like a long time closed during COVID for evictions from it's 7 years ago, but in in in this They've made a whole bunch of changes to lot of it is in recognition of there's
- 16:00you know, wages are going like this and can't afford places. So, I I think that they they make it I I don't know if I want to say more it's just a it's a more fair process for Um yeah, it used to be that you when you non-payment of rent, you have to give 3 Um the court the court proceeding would be 17 days. Um automatically get an adjournment for 14 just by asking for it. At least that's It's always only as good as the judge
- 16:54you know, it doesn't doesn't always supposed to happen. And then on the back the sheriff serves it, it used to be 72 you. Now it's 14 days. Uh it used to be days including weekends. So, there's so uh in places that have an opt-in to good a little bit cuz that's probably the if you have a month-to-month tendency, somebody 30 days notice and they're process. If you've been there for less you've been there for one or two one or And if you've been there for more than
- 17:46And um, I I think that along with good uh kind of level the playing field for of it. Um, and I don't have any mine and I think it's true is that I local and state legislators are trying you've got people that are, you know, if going out and going and there's, you neighborhood. And I think that's part of the goal is here. So, so those are some basically says that you can't have those lease or evict them at the end of their um, law has been. You can't you
- 18:37you can do it for a no reason, you can't discrimination, retaliation, those kind way the state law was set up, um, that that you know, good cause eviction municipality that opted into it. And it. Catskill has opted into it. Albany just opted into it, which is really one very landlord friendly place. Um, what that means is basically that you good reason to do so. Of course, you you know, uh you don't allege that obviously not there are lots of exceptions, but you you know, this this person made me mad
- 19:33to be some that you can prove in court if necessary that's it's been great for us so far in it is probably, you know, still developing judges that come on the bench and go off are kind of learning how it works. but uh um the other thing that that that is right to counsel in eviction cases. very like like in criminal cases, you're an assigned counsel if you're income but for eviction cases. Um they have has not come upstate yet. Um something else that's in development
- 20:33great because, I mean, you know, people really it really does a lot to children families apart. And there's a lot of bad evicted and so I think that um you know, Legal Aid, so I think this, but but that can be put in, um for a a lot of families and and and there are you know, a lot of studies there's you know, exciting things are Uh, and I think that's pretty much it. have them call. help them. God. It would appear that way. Yes. I should
- 21:29and uh, I'm happy to be here. I was insurance both from a tenant standpoint I think I'll endorsements because we all are familiar that have got their own homeowner's Um, you know, it's advisable obviously can have, an all risk policy or what most comprehensive. between it and the next level down is just simply doesn't make any sense uh, um, has got inferior coverage because it. The the few things that I'd like to is just the cost to rebuild. Uh, we've tell you probably better than anybody
- 22:33square foot uh, process. It's probably square foot to rebuild. And it's it's an after not uh, excuse me, not night you know, we saw a huge increase in the especially with these older buildings in being where here, uh, but you mentioned Um these brick buildings, it it is And for instance, if you've got a foot building, and and you you've got um that's not enough. about $800 a square foot to rebuild that my head, that's just a little bit under Well, I've been I've been in this
- 23:40you right now, I remember on Warren Myron Cohen, Twin Fish's building. he all he I only paid 50,000 for the Well, because there was the rents were too of commerce going on in the city of Now, that same building, I I've seen the coverage on that building to maybe like dollars because the new landlords have costs are. what's the difference? Why can't I just own it? Well, you can do pretty much if if um if you don't have if your to within 80 or 90% of its replacement
- 24:47insurance company that you're with. you're going to get a severe penalty So, to give you an example of of a kind if million dollars in coverage on it, but $500,000 of coverage, kitchen fire, the building inspector is "Oh, you know, time out, you know, tenants vacate the building. They're insurance adjuster is going to come in Well, I had a half a million dollars of They calculate based upon local building So, they take what you did have, divide and and get a percentage. Well, that's is 50%. Well,
- 25:55before, you should have had either 8 or 900,000 million-dollar replacement to get 100% fire that the fire for everything that loss the insur- any insurance within 50% of the replacement value. going to get 50%." So, instead of $100,000. So, $100,000 is going to come huge issue for us because, and years and years and and money's going to cost you foot or more to rebuild, they just don't want to pay check the policy, move your deductibles really need to be within at least that Um or else you're going to suffer a big
- 27:21standpoint, the other item that we're being an old city, you've got bad Um creating a lot of vibration and those your your your inlets going into the your buildings. policy of insurance unless you add time and time again. It's a simple policy. Typically costs you 75 bucks and in coverage seeing some water running into your the DPW said, you know, I think we got a Well, old a building in Chatham where um the the the water was but the the village knew that there was it turned out that that was the where
- 28:36buildings. They lost an enormous amount responsibility. They paid to have all paid a pile um of claims in this in this city on staying on the the the water line. um buildings. a hill. down the hill. Where's it run into? have these huge, you know, 2-in uh uh I don't care that the that this is an even the new drainage systems can't to fit through those pipes. And when it expanding, not contracting. So, it can't going to go? Well, if you're the unlucky floor drain in the basement, it's going
- 29:41ruin your basement. And God forbid if or a lot of utilities. flood policy. policy. What you can buy is an Depending upon the company, 50 or 100 And you know, God forbid, you know, it's then it's then you've got the health nasty situation for a landlord. you can add to your policies that that any city very very happy because you're tenants are going to be a lot happier or just use the building. Cuz if you situation. so, the the key points Um, the other one that I like to make is
- 30:54Um, owner building owners don't understand there's a loss and you have to live landlord, loss of rents coverage. If living expense. And what that means is elsewhere until until the the damage has I can't stress enough with the rising usually owners don't have enough loss of rent enough additional living expense. you're looking at the overall premium. just a couple of things that probably would go in in line with with stoves. Don't like wood stoves. They're fireplaces. tenants Um, that we we see quite often is is
- 32:10Well, that's a business exposure. that coverage on your tenant homeowner's And and lastly, I'll just hit this time. You look at your time on me over Anything happens in the whole world, it You can go as long as you want. But Yeah, actually want you to pay more
- 32:39on it? That's right. Well, you you you But uh uh tenant's insurance I I with younger people income and and it's ah I can't afford Well, you know, can you afford a couple Well, yes. I said, "Well, that's what's And believe me, if there's a loss a cup an extra cup of coffee a day whatever your pleasures are, you know have to have, you know, in your back Um uh that the tenants they they they just contents coverage with 300,000 limits of they just fall. And here's the dirty
- 33:39most do, you get a couple of discount literally will give you your tenant's is not costing you them anything. and it's probably going to you know, the high, it's probably going to save you save you money in the long run. the one thing that I also want to bring here we have landlords that ask a tenant to on their tenant policy. It can be done. business policy with a mercantile down that you can list a commercial entity as a commercial policy. request that attorneys will ask
- 34:49And If you look at any insuring agreement look at the the definition of a named which if you're an additional insured, definition of the named insured. Donald Ferrante, his wife, his his relatives. That's all that's going to be insured. Period end of story. if uh policy, this is for you, baby. it's an LLC that they want to add, it by law a foreign entity and that will So, what you just need to do is say, homeowner's policy. updated at the annual renewal of their So, that at least the landlord knows
- 36:05that they're going to be insured. That a businesses on Orange Street, the commercial entity. So, you can add that owns the building individually or based but you know, it's just it's something are are are being requested to to have company does it, it adds that. not worth the paper that they're written So it's going on record for that. Other you know, that's all I have. Be happy to Um already indicated on the tenants quite frankly on the landlord and the the uh reasonable. And by the way, the Plenty

We've plenty of cucumber. somebody broke into my apartment when I father had tenants insurance because it we were able to get it and so I was I I the foresight to have it. Um but it was because it was it was a key entry. It Um anyway, so there's your plug for I didn't have to get my stuff replaced Also, if I may give him a plug, uh we talked about uh as far as like building everybody knows Wonder Bar. That place
- 38:00Under insured. Um also, been here a couple of months and I've times where people's basements get water uh anything else they have down in their have on it that they didn't have the on them to make the repairs. attorney over by the court well remember where everything is. They But um yeah, he had all these valuable sorted. Unfortunately, we had the you know, he was brought home something I don't know. Thanks, Kurt. and my personal property gets damaged by owner or landlord, uh carrier go against his insurance
- 39:20It It can do what's called a subrogation to One of the the classics is I remember buildings here. The first person to have tell you when he sold the four were a he had a hot water heater burst in one down below. and they tried to go after him and he he doesn't know when a hot water something like that, but it's just if there was a situation where a tenant pipe there. It looks like the thing is it's going to burst." And he didn't do
- 40:11you know, to your point about getting uh then absolutely that tenant's policy You're you're made whole, and then and subrogation This is riveting stuff, isn't it? There's there's a those two things when it comes to stores, when it comes to regard. unfortunately, you know, serve a purpose. training for emotional support dog is dog is is is trained to ignore other handler. They're you know, they're not a a service dog, He's here to do a job.
- 45:59service dog and social social dog is the they're not aggressive there and they're not a nuisance. We have a lot of people that call, people have to sit on hold for quite a close to 9:00 a.m. as you can because, people with all kind of problems that charge anything, you know. So, I I tell says free lawyers, and and they call, lawyers are expensive. for aging right now, too. Is that a new
- 48:54I don't know that we covered that here. I know we cover it in Albany County and have an attorney there in I thought I to cover that. Yeah, I think there was there's an attorney there, but I think Okay. I just heard recently that she's going to be potentially partnering with happening. don't know. wouldn't be the same attorneys that deal case. So, it would would it be someone or are you not sure at all? would be We have two lawyers that do not that long ago that do senior legal
- 49:43that involves issue, we don't do criminal stuff. But, living wills, Um there's a lot of housing in that cases get kind of complicated, they can So, I know. the city of Hudson has a grant access to Uh and that's what that means someone or has a home. to stay in your home. can contact Michelle Tutolo at the city What that does is if you need a ramp or bathroom you to stay in home, you through the grant. you know, I also know that Habitat not specific to
- 50:57not just older people, but if anybody work on their houses housing to weatherization, things like that, it's a not utilized that much at all. The other issues that people may have. insure rescue squads around. And I believe it's where they have all of the durable let's say is being discharged from the need a thing for their toilet or they them and will actually let them, you so they don't have to, you know, have to policies don't offer the the full equipment or there's a limited amount
- 52:07a lot of stuff and it's I think they're uh EMSs in the area. And and you know, you, but I know for my family we've got kids have got. Now they just sit in the again. Not got to do. has to show receipts as to why it wasn't and what they deducted from that that if you don't get the security get back those receipts are happens there is the landlord forfeits And if it can be proven in court that he
- 58:09uh whatever, possibly get up to twice the security for renters to know where is my security deposit? It didn't had a case where a woman in security deposit. She moved out. The and with a an itemized list, that's not the actual work done. Mr. Roemaker Attorney Roemaker alluded the law of 2019 protection. with that same the length of tenancy a notice of tenancy has to be compliant with the less than the the termination of tenancy can be 30 If it's 2 years, or if it's um
- 59:48And if it's 2 years or more, it can be people saying that I got a text message uh uh And the person's been living there But the property's been sold, get uh more rent, And so I get an awful lot of cases where notice. Attorney Rohlfing can tell me a little who get a 14-day notice for nonpayment but they never got a 5-day notice. Yeah, the five I didn't mention that the 5-day notice is with the 14-day notice, the 14 days have notice, the 5 days have to pass before
- 1:01:02other words, to be set by the landlord by certified 5 days late. So, if it's not there by the fifth, on the sixth or a notice that says, "Hey, pay your rent this month." And it has to Um point after that. A lot of times the like if if um got a 14-day notice." My question is "Did you ever get a 5-day notice by many cases they don't get it. part of a
- 1:02:01It It is a defense in court. But it It's where if in certain circumstances you If you can't work out an agreement with want to dismiss the case because I want That is not that. That is the landlord, prove that they served all the notices that 5-day notice. And if you go through we did this and this and this and they point you can say you want it to be they served the 5-day notice. But again, really all contexts, right? The The The police officer, the law is only as good
- 1:02:49there. When you go to court, the law is enforce it. I've been One of the first school, I was in southern Ohio in the and I had it right there. It didn't this is what the outcome was going to be And people do not realize that. People law." I'm like, people rob banks, they all the time. And you know, I I I around an hour down Central Avenue in Albany some of these landlords are going to maybe I could just do whatever I want, wouldn't be able to do that, but um
- 1:03:32and the way but what the law says and they do go and sometimes they don't go. get into town and village courts, and I or anything, but you've got people who they don't know the law and then you try attorney going down there. I got this read this. And then they look at you heads. They don't know what the hell that because that may not know these things and and it it's not fair to the tenant and in cases like that will usually I'll get cases where people say
- 1:04:27did you tell them that you have a district going to be detrimental to their to and you have a disability yourself and the peace or or then when they come out of court, I that?" And they said, "I didn't have the Right. Well, it used to be that it with the can prove hardship, you can get No. the and there are various things of lot of times if we do those hardship you know, like someone's move now. They're on their getting chemo. They can barely even stay
- 1:05:30people it's it's March. There's three Can we just let them stay till the end that is though you have to be able to be paid along with that stay, which there's also if you get convicted for period to cure that now under that same because you had a dog and the lease says You could have 30 days to get rid of the "It's cured now." And and it's supposed the 10-day notice to cure anymore. Well, Beforehand they have to give you a notice to cure to cure. But if you don't
- 1:06:17Instead of getting evicted right away, you can um lease. As long I think as long as it's you you know, like if there are
- 1:06:32illegal stuff going Yeah, drug dealing, hard to say I cured it. That's we're smoking in your unit. We have a lot of understand. They think cuz pot's legal anywhere and if it's not If your lease subsidized housing, You can't do it, but that is Do you cure? You can bring in a witness and and say, and and and he doesn't smoke inside And with that cigarette smell, whatever. though, you know, the laws are only as that will enforce them, but also people place from forums like this, which is a
- 1:07:28the don't even know that you you have the Another couple questions regarding um to provide interest on security um required if the owner has six units or that's right. It is Six units deposits in my Don't Do you get interest on it if it's a month I thought you only had to pay rent or that, but that might not be written, it's six units or more and the can retain 1% administrative fees. interest rates what they've been whole Right. Right. Yeah, it's really so that's that's
- 1:08:46it is still advised that it be kept Yeah, deposit. separate account. Interest is six units or more than Um since with these new 2019 laws that stretch out the process of do can landlord get a refund through funds through the court process? Yeah. Yeah, no, that would be he just said, you know, they can apply mean they're not paying rent for that
- 1:09:37I think they have to. The the the the I the judge would order that the rent But, put it in escrow first. because it you know, you can't just say, stay till the end of the school year. doesn't work that way. They have to It know how a judge would handle it if a realize that. But, if someone were getting evicted for to court and they say, "Well, I have treatment. I need a year." of that law that that says that you can eviction after a year It has a component
- 1:10:20Part of that order has to be that the and I think if it wasn't, then I think they would get thrown out. Okay. Is allow for a loss of nonpayment of rent? and can't fill the apartment? trigger on on your uh on on a peril that you're insured about. you know, the only thing is is if you vandalized the apartment in some way, you know, we've seen that where they
- 1:10:54Yeah, for sure. out and the copper people what it is and uh do that, that's other people. So, do you guys have any questions in the panelists? Um I do. - 1:11:47just have no overseer over that site to landlords and what they're doing to Um and then as far as like looking for application fee, how can that be waived for places and like paying $35, $25. with like questioning you about your boyfriend, you know, it's just things a lot of What do you mean application pay for it
- 1:12:26renting apartments don't think it's 20 bucks. and like more. They break the law all that New York state law in 2019 that was try informing them.
